Claims for Assault

 

Am I eligible to make a claim ?

You are eligible to make a claim if you reported the incident to the police within 48 hours unless you were unable to for a good reason. You must also have been seen to assist the police in making their investigations by making statements where nescessary. You will not be able to make a claim if you refused to make a statement or press charges.

Sexual assault claims

You can claim compensation for a single sexual assault . If you have been abused on a number of occasions over a prolonged period of time please see the 'Abuse Claims' page. We understand that this can be a sensitive subject and we will deal with your claim discreetly. You may also choose between a male or female representative to deal with your claim. You can still claim for sexual assault if there are no physical injuries.

What if the offender was not caught?

As long as you assisted the police in their investigations you can still claim if the offender was not caught.

What if I have a criminal record?

The criminal injuries do take criminal records  (un-spent convictions) into account when making offers of compensation. Depending on the severity and nature of your offences the CICA may decide to deduct a percentage of your award or make no offer what so ever.

How is my award calculated?

Your award will be based on medical notes about your injury. The award its self will be calculated using a guideline system which can be found on the Injury Value page.

How do you get paid?

Ram Legal Services will deal with your criminal injury claim on a 'No Win No Fee' basis. We will only request payment once you recieve your compensation. We take a standard fee of 25% of your award for assault claims and 15% for sexual assault claims. There are no hidden charges or VAT that are added. For example if you are awarded £1000 you will recieve £1000. We will then request payment of £250 for the work we have done.

Do I have to use a legal representative?

You do not have to use a legal representative and you can apply to CICA direct. By doing this you will be responsible for your own application and will have to make your own appeals etc.
